Q. Why is gathering evidence for a child custody battle
so difficult task?
A. When first asked, you are able to list dozens of incidents
that clearly demonstrate the true blatant disregard the opposition has for
your child. You can name many people willing and able to testify to the
neglect, abuse, lying and even the illegal activities they witnessed. However, as time passes, memories fade and the incidents
have become so common place that your witnesses lose the desire to get
involved.
Q. The police were
called out for several of the incidents. Will that help my case?
A. Your case can be strengthened by
documentation that indicates bad or dangerous behavior on the oppositions
part. The court finds patterns of behavior compelling. Only proper
documentation by the officer and your prompt acquisition of copies of
those incidents will preserve their value.
Q. Things weren't so bad
five months ago and I don't think the officer wrote up a full report.
Can I get the officer to make a report about the incident for me now?
A. Attempting to get documentation
produced after weeks or months have passes is useless. Even obtaining copies of
properly reported and documented incidents can prove impossible.
Q. The opposition
does so much bad stuff, how do I document everything?
A. The court has determined which
information it will consider. They call these 'issues' and which
information it will not consider and they are called 'non-issues'. Don't
waste your time documenting, even if the opposition routinely demonstrates
poor judgment or does things that hurt your feelings, if the court sees
the information as a 'non-issue.
